Your booking for these vacations involves an agreement between you and those who provide the services. Anik Tour Ltd. dba Pacific Gold Tours & Travel does not own, manage, control or operate any transportation vehicle, train, plane, hotel, resort, cruise ship, restaurant or other suppliers of different services. The contractual relationship herein shall be governed by the laws of the Province of British Columbia, Canada. Please read all the information on these pages, before you make any payment. It sets out the conditions covering your tour booking with Pacific Gold Tours for travel and other services provided. Pacific Gold Tours is a division of Anik Tours Ltd.
Anik Tours Ltd. dba. Pacific Gold Tours & Travel is a wholesale tour company based in Delta, British Columbia, Canada licensed and bonded under the BC Travel Industry Act. Registration #2594-4. All consumers’ payments to Pacific Gold Tours are held in a trust account.

To protect you against international currency changes, we offer you full price protection by guaranteeing our published brochure prices will not change, no matter what increases may occur in currency, gasoline, and other costs. (Airport, cruise ship & port taxes are excluded).

DEPOSITS AND RESERVATIONS:
The following scale of non-refundable deposit is required on all tours at the time of booking to confirm the reservations:
Tour 10 days & under……......................................................$400 per person
11 to 20 day tour……………...................................................$600 per person
21 to 30 day tour……………...................................................$800 per person
Balance is due 60 days prior to the tour departure for escorted train, motorcoach and Fly/Coach tours. Cruise tour balance is due 105 days prior to departure. In the event that you book the tour within the above time period, then the total cost of the tour is due immediately for all tour packages.

CREDIT CARD
All credit card payments will be processed in Canadian funds. We accept VISA & MasterCard. It is your responsibility to provide a signature on file for all credit card payment requests. A copy of cardholder’s signature on universal charge form is required by our office in order to consider a payment of the file.
AUTOMATIC CANCELLATION OF BOOKING
If deposit payment is not physically received in our office within 5 working days of the booking, the file will automatically cancel without notice. Also, if full payment is not received in our office within required time prior to departure, the file will automatically cancel and the deposit will be forfeited.
TAX & SERVICE CHARGE
These charges are comprised of provincial accommodation tax, hotel levi, stateroom tax, baggage service charges and administration costs on each tour.
EARLY CONFIRMED DEPARTURES
Based on many years of operation and popularity of these tours in previous years, we have predicted some departures as Early Confirmed Departures for your early selection & to take advantage of our early booking bonuses. We will guarantee each operating departure at least 70 days before the departure date. If any departure requires to amalgamate/cancel, you will be notified immediately. If a tour is cancelled, we will definitely protect your booking on an alternative date, if available. If that date is not acceptable, all payments on particular tour will be refunded in full immediately. Air ticketing is not advised on any tour not guaranteed.
INSURANCE
Pacific Gold Tours is not licensed to sell any kind of insurance. Insurance on any tour booking is strongly recommended by Pacific Gold Tours for interruption, cancellation and medical coverage to ensure that you are well taken care of prior to, during, and after your vacation. We suggest you must consider purchasing a comprehensive insurance coverage from your insurance agent, Credit Card Company and/or a travel agent in your area for your peace of mind. Pacific Gold Tours will not be held responsible for missed connections, incorrect check-in times, or improper documentation. Any additional expenses caused by late or cancelled transportation carriers will be borne by the traveller.

The tour cancellation day and the day of departure is excluded when calculating number of days for cancellation penalties. Cancellation penalties apply to the tax & service charge amount also on all land tours. Please protect your investment by insuring the full amount including tax & service charges. Tour cancellation notice must be received in writing at our office to be in effect on all tours.
CUSTOMS & IMMIGRATION
A lack of proper documentation or a previous criminal record of the passenger may lead to his/her denial for boarding or entering the country. Pacific Gold Tours cannot be held responsible for denied boarding or entering in such situations.
TOUR DOCUMENTS
Baggage tag, name tag, tour itinerary, pick up points, list of all hotels, travel tips, etc. will be sent to your Booking Agent three weeks prior to tour departure. Pacific Gold Tours is not responsible for any lost or stolen documents.
REVISION FEES
A handling fee of $30.00 per transaction will be charged for any alteration or revision made to a reservation within 45 days of departure. This includes changing departure point, smoking or accommodation preference.
SHARED OCCUPANCY
When requesting shared accommodation and a partner is not found, the single rate will apply. If a partner is found, we assume no responsibility in the case of added cost due to any situation changing the status of booking occupancy later on during the tour.
MEALS & ATTRACTIONS
Pacific Gold Tours includes some meals and all major attractions with admissions included for your personal enjoyment, budget and touring enhancement. Sometimes our prices may be higher to provide a quality tour. Please compare the total value of the tour, not the price only. Pacific Gold Tours stands solid for “Gold” quality & value.
The following abbreviations in tour itineraries indicate that the meal is included:
CB = Continental Breakfast; B = Breakfast; L = Lunch; D = Dinner.
BAGGAGE
Each passenger is allowed one suitcase and one small handbag. Handbags must fit in overhead compartments. The suitcase must be identified with the Pacific Gold bag tag provided in your tour documents and will be handled for you at each hotel. Pacific Gold Tours cannot assume responsibility for lost, stolen or damaged luggage. Baggage and all other property will be handled at the passenger’s risk.
We recommend that you purchase baggage insurance for your peace of mind.
YOUR TOUR DIRECTOR
Will accompany you for the whole trip. You will find them to be knowledgeable, courteous, and ready to please you in any way they can. They will provide an interesting commentary along the way and accompany you to many special attractions.
GRATUITIES
All hotel & train baggage gratuities and gratuities on included meals at hotel & onboard train are included in package price. You may wish to show your appreciation to tour directors and bus drivers. This practice, although customary, is not included in our tour price. If you wish, such appreciation should be extended on a voluntary basis and not as a group.
TRANSPORTATION
Coaches are ultra modern, air-conditioned, washroom-equipped, and designed for comfortable traveling. Coaches are supplied by a variety of carriers, and are designed for your traveling comfort.To the best of our knowledge, ships, trains, motorcoaches and other conveyances used in conjunction with our tour packages, are operated by reliable companies.The airlines concerned are not to be held responsible for any act, omission or event during the time the passengers are not aboard their aircraft of conveyance. The passage contract in use by the airlines when issued shall constitute the sole contract between the airlines and purchaser of these tours and/or passenger. The service of any IATA carrier may be used in connection with the air portion of this tour. Please read documentation carefully. All flight itineraries, hotels and day-to-day itineraries are subject to change without notice.
CULTURAL DIFFERENCES
One of the joys of travelling involves the differences you will encounter. It may be that living standards and practices, and standards and conditions with respect to the provisions of utilities, services and accommodation are different than in Canada. The traveler who knows this is the traveler who will most enjoy his or her trip.
SCHEDULE CHANGES
May occur, and in that event, we reserve the right to make any changes in plans which may be necessary due to local conditions to add to the comfort and well-being of the touring passengers.
SERVICE DELAYS & FORCE MAJEURE
Any responsibility or liability to Pacific Gold Tours or the failure to perform any of its obligations is expressly excluded by any manner or cause beyond its control, including but not limited to, fire, explosion, weather, acts of God, accidents, supply, riots, strikes, insurrections, emergencies, catastrophes, government interventions, controls or otherwise.
OTHER
NO WAIVER
No person, other than a senior authorized representative of the company, by a document in writing, is authorized to vary, add, or waive any term of condition in this brochure, including any term of condition set forth in the preceding provisions.
OTHER CONDITIONS
It is your responsibility to comply with the terms, conditions and/or requirements of any service provider, of any country or governmental authorities. Passengers must bear any costs or losses incurred as a consequence of you (the passenger) not complying with them.
ACKNOWLEDGEMENTS
The passengers hereby acknowledge having read the within provisions relating to our responsibility. Also, when you book your tour with Pacific Gold Tours and make a payment, your agreement to the terms and conditions stated on these pages is confirmed.
VALIDITY
The validity of this publication and its booking terms and conditions is from January 10, 2011 to December 31, 2012. The tour information published in this brochure supersedes all previously printed tour information and is subject to change without notice.
TOUR OPERATOR’S RESPONSIBILITY
All arrangements for accommodation, transportation, and/or sightseeing tours are made by Pacific Gold Tours, Canada and/or their appointed representatives, who act only as an agent for the passengers in regards to travel, whether by railroad, motorcoach, ship, or plane. Pacific Gold Tours and/or their appointed agents shall not be responsible for any act, omission or fault of such carrier, arising out of any causes whatsoever. Pacific Gold Tours and/or their appointed agents shall not be responsible or liable to the customer, or any other person, for claims, losses, damages, cost of expenses arising out of injuries, which may be occasioned either by reason of defect in any vehicle, or for any reason whatsoever, or through the acts or defaults of any company or person involved in conveying the passengers, or in carrying out the arrangements of the tour, whether any such claim or cause of action shall be caused by or arise from any wilful act, default or out of the negligent act or omission of Pacific Gold Tours and/or their appointed agents. Pacific Gold Tours and/or their appointed agents can accept no responsibility for losses or other expenses due to delay or changes in air or other services, missed connections, sickness, weather, strike, war, quarantine or other causes. All such losses or expenses will have to be taken care of by the member of the tour, as the rates provided here are for arrangements of tours only at the time stated. The right is reserved to make adjustments to the itinerary, to substitute hotels specified, and/or to cancel or change all or any part of the travel agreement at any time, in which case an appropriate refund shall constitute full settlement to the passengers and/or his representative. No refund will be made for any inconveniences, whether physical or mental, including, in particular, mental distress. The right is reserved to decline, to accept, or to retain any person as a member of the tour. The transportation companies concerned are not to be held responsible for any act, omission or event, during the time passengers are not on board their airplanes or conveyances. The conveyances concerned, when issued, shall constitute the sole contract between the airlines, cruise lines or conveyance and purchase of these tours and/or passenger. Written notice of any claim against Pacific Gold Tours must be received by our office no later than 14 days after your completion of the tour.
